Georgia Nursing Home Abuse and Neglect Lawyers

With many of them suffering from physical or mental impairments, the elderly can be among the most vulnerable members of our society. Unfortunately, when we place our elderly family members in a nursing home or other long-term care facility, staff and employees may take advantage of their position of power by abusing, neglecting or exploiting them. In fact, one study has found that up to 25 percent of vulnerable adults will be abused every month, or six percent of the total elderly population. This type of misconduct cannot be tolerated.

At Blasingame, Burch, Garrard & Ashley, P.C., our personal injury lawyers are dedicated to stopping nursing home abuse and neglect and securing compensation for victims and their families. If you believe your loved one is being physically or emotionally abused or neglected, we want to help you. Call us today at (866) 354-3544 or use our online form to receive a free consultation at one of our Northeast Georgia offices in Athens or Lake Oconee.

What is Nursing Home Abuse and Neglect?

The symptoms of nursing home abuse or neglect may be hard to detect, especially when the elderly resident is subject to emotional abuse, such as threats, intimidation, ridicule and humiliation. If your loved one is experiencing depression and anxiety, however, it may be a sign.

Physical abuse and neglect is more apparent. Abuse can include hitting, slapping, restraining, confinement or improper medication, and it may be seen through unexplained cuts, bruises, sprains or fractures that result from violence or falls that go untreated. Neglect may be seen through malnutrition, dehydration, bedsores or poor hygiene. In some cases, a nursing home resident may be sexually abused.

When abuse or neglect occurs, the nursing home may be held liable for its negligent hiring, training and supervision of staff and employees or for negligently maintaining the premises.

In Georgia, the majority of nursing homes are privately owned and operated, including several that are part of a national chain. These corporations are well-funded and well-organized, and they will use their resources to challenge any claims against them. However, we believe our firm’s size, resources and talented attorneys and staff can level the playing field. We will thoroughly investigate and develop your case, and we will aggressively advocate on your behalf.

Delivering Results for Our Clients

Whether your case involves a personal injury or wrongful death lawsuit, we will work hard to obtain a full and fair settlement or verdict on your behalf. Although a settlement will be our primary goal, we will always be prepared to take your case before a judge and jury.

Our recent results in nursing home abuse and neglect cases include:

  • $550,000 settlement with a nursing home for failure to appropriately investigate an employee before hiring, which resulted in patient abuse by the employee.
  • $250,000 settlement with a nursing home in a case involving a resident’s continued falling and suffering of injuries.

It’s important to seek legal assistance soon after you believe a loved one is suffering from nursing home abuse or neglect. Georgia’s statute of limitations generally bars any personal injury lawsuit that is filed more than two years after the injury (or discovery of the injury), and it also bars any wrongful death claim filed more than two years from the date of death.
